Privacy Policy

  1. Purpose and Scope

This is the privacy policy (Policy) of Riverside Marine Holdings Pty Ltd ACN 009 797 791 and its related companies (Riverside Marine). Riverside Marine is committed to the protection of personal information in a manner consistent with the Privacy Act 1988 (Privacy Act) and the Australian Privacy Principles (APPs).

The Policy is intended to provide information on the following:

  • What personal information is collected by Riverside Marine
  • How Riverside Marine collects and holds personal information
  • How Riverside Marine uses personal information

The Policy also informs individuals how they may access their personal information collected by Riverside Marine and request corrections if necessary. The Policy also advises how individuals may lodge complaints regarding

Riverside Marine’s conduct with personal information and how Riverside Marine deals with such complaints.

This Policy applies to personal information collected by Riverside Marine. Personal information is defined in the Privacy Act as ‘information or an opinion about an identified individual, or an individual who is reasonably identifiable’.

  1. Requirements

2.1.Information Collected

Riverside Marine only collects personal information where the information is reasonably necessary for one or
more of Riverside Marine’s functions or activities.

The type of personal information that Riverside Marine collects and handles varies for different parts of Riverside
Marine’s business operations and includes personal information about Riverside Marine’s customers, suppliers,
contractors, job applicants, employees and visitors to Riverside Marine’s websites and sites.

Examples include:

  • Customers and visitors: names, addresses, phone numbers, email addresses, other contact details.
  • Job Applicants and employees: names, addresses, phone numbers, email addresses, other contact details,
    employment history, educational qualifications, bank account details and superannuation details,
    recruitment records and personnel records.
  • Contractors and suppliers: names, addresses, phone numbers, email addresses, other contact details (in
    relation to owners, directors, officers, partners of a partnership and other individuals working for Riverside
    Marine’s contractors and suppliers), procurement records, consultancy records, committee membership details, bank account details, creditor and debtor information..

2.2 Process For Collecting Information

    Riverside Marine will collect personal information from you wherever it is reasonable and practical to do so. In
    some instances, Riverside Marine may collect information about you from third parties. Riverside Marine may
    collect personal information about you via:

    • Information you provide to Riverside Marine directly, for example when you communicate or interact with Riverside Marine by telephone, email, online (including through Riverside Marine’s website) or in person;
    • information from third parties, including:
      • if you are a current or prospective customer, applying for or receiving credit from us (or if you are an owner, director, partner or other individual connected with such customer);
      • Suppliers and other third parties who provide products and services to Riverside Marine; and
      • Publicly available sources.

    You must only provide Riverside Marine with the personal information of someone else if you have that person’s consent to do so.

    If Riverside Marine receives unsolicited personal information, Riverside Marine will determine whether that information could have been collected in accordance with the APPs. If Riverside Marine determines that the information could not have been obtained in accordance with the APPs, Riverside Marine will consider whether it is obliged to retain that information. If not, Riverside Marine will destroy the information or ensure that the information is de- identified if it is lawful and reasonable to do so.

    Riverside Marine uses an electronic records management system for storing its information, including personal information. Hard copies that held will be subject to physical security and restricted access.

    2.3.Use of Personal Information

    Riverside Marine uses personal information to undertake a range of business-related activities. Where you are a job applicant, employee or contractor this includes collecting and using personnel files in order to carry out the functions necessary to manage human resources. Personal information in these files may include applications for employment; terms of employment; records relating to employee’s salary, benefits and leave; medical certificates or health related information; any criminal records; contact details; taxation details and superannuation contributions. For clarity, nothing in this Policy is intended to limit our permitted handling of information under privacy laws. For example, under the Privacy Act, we may rely on certain exemptions including in relation to employee records.

    Where you are a customer or work for or are associated with a customer this includes responding to your comments or questions and fulfilling requests for products and services, to assess and investigate any complaints and for marketing purposes. Where you are a supplier, this includes managing the purchase of goods and services. More generally we use personal information to manage security, health and safety.

    2.4.Direct Marketing

    From time-to-time Riverside Marine may send you direct marketing communications regarding Riverside Marine’s products and services.
    Riverside Marine may contact you by electronic messages (e.g. email), online (e.g. through Riverside Marine’s websites), by mail and by other means, unless you opt out or Riverside Marine are subject to legal restrictions. You may opt out of receiving electronic messages from Riverside Marine at any time by contracting Riverside Marine Privacy Officer via the contact details below or by using the opt out mechanism included in Riverside Marine’s marketing messages.

    2.5.Personal Information Disclosure

    Riverside Marine may disclose personal information, to various third parties for any of the purposes identified above.

    Riverside Marine may disclose personal information to:

    • Various third-party suppliers, which provide materials and services and support for Riverside Marine’s business;
    • Riverside Marine’s related companies;
    • Riverside Marine’s service providers, including accounting, auditing, legal, banking, payment, debt collection, delivery, data processing, data analysis, document management, research, investigation, technology services and training providers;
    • A third party organisation in the event Riverside Marine sells or transfers all or a portion of Riverside Marine’s business or assets;
    • Your organisation and representatives; and
    • Government agencies for reporting and compliance purposes.

    Is any of the personal information transferred overseas?
    Some of the third-party service providers or suppliers to whom Riverside Marine discloses personal information are located outside of Australia including Europe and the United States of America.

    2.6.Information Security and Accuracy

    Riverside Marine will take reasonable steps to ensure that personal information held by Riverside Marine is accurate, current, complete and relevant.

    Riverside Marine will also ensure that personal information is reasonably protected from misuse, interference, loss and from unauthorised access, modification or disclosure through a range of physical and electronic security measures including restricted physical access to Riverside Marine’s premises, security firewalls and computer user identifiers and passwords.

    2.7.Access to Own Personal Information

    Individuals can request access to their personal information held by Riverside Marine. They can also request Riverside Marine to correct their personal information if it is incorrect.

    If you are lodging a complaint Riverside Marine Legal Counsel will confirm receipt of your complaint. If the Riverside Marine Legal Counsel believes an investigation is necessary, Riverside Marine will open an investigation into your complaint. Riverside Marine may need to contact you to request further details of your complaint. If an investigation has been opened following a complaint made by you, Riverside Marine will contact you with the result of that complaint as soon as possible.

    In the unlikely circumstances Riverside Marine are unable to resolve your complaint to your satisfaction, you may be able to contact the Office of the Australian Information Commissioner at www.oaic.gov.au.

    3. Key Responsibilities

    All persons engaged in activities on Riverside Marine owned or operated asset must comply with the requirements stipulated in this Policy.
